Having said that, I need to sort out the new anti-spamming laws.
You may wonder what spamming has to do with sending out a
newsletter. The new anti-spam law in California places
legitimate newsletter publishers at a strong risk of being
prosecuted as a spammer, even if you only send to opt-in
subscribers as I do.
Newsletters must generate enough revenue to cover the cost of
production and distribution or it will lose money and eventually
fail. This is typically done by selling advertising space for a
either flat fee or a commission on sales. Right now I am carrying
the production and hosting costs so I can keep this newsletter free to
subscribers.
The definition of an advertisement in California's new law reads:
"Electronic mail advertisement means any electronic mail message,
the principal purpose of which is to promote, directly or
indirectly, the sale or other distribution of goods or services
to the recipient."
A publisher must have EXPLICIT PERMISSION from each subscriber
to include advertising in his or her own newsletter! Lacking
this, a publisher is susceptible to prosecution for any email
sent to a California email address or from a California email
address and subject to court interpretation, to or from servers
located in California or routed through California servers.
The penalties can be severe.
With the California law, all a person has to do is prove they
have a California email address and claim they didn't give you
permission to send them commercial email and that they have no
previous or current business relationship with you, or claim
that they requested to opt-out of your mailing list and you
didn't honor the request, and they can sue you.
Unlike with other laws, you are GUILTY until and if you can
prove yourself innocent!
Some people will forget they have subscribed and falsely accuse
you of spamming them. This happens with alarming regularity to
every publisher with a list of any size. For this reason alone,
I always refer people to my web site to sign up for themselves
so I couldn't rightly be accused of spamming. Yet, each time
I send an issue I get a few
from AOL saying so-and-so reported my newsletter as spam.
The long and short of it for me is this - I need to protect
myself from the risk of my home and life savings to
offer a free newsletter when the rules have changed so
drastically. I have no real choice in the matter as the new laws take affect.
Because of the broad wording in the California law, even sending
a notice that a newsletter is online can be construed as spam if
there is advertising on the web site that hosts the newsletter.
Some colleges suggested that I charge subscribers a small one-time
registration fee which will give me a printed record of the
financial transaction which would keep me safe from prosecution
against false accusations of spamming.
I'm still willing to take some risks
For the time being, I'm relying on the integrity that anyone who
signs up for my newsletter has read, understands and agrees with
my reasoning. If I do get more than a few complaints of spamming
readers (many of whom forgot they signed up) I will move to a
subscription plan that requires a registration fee to protect
myself and family from frivolous law suits.
This is still a FREE newsletter but.....
If I do go the route of a registration fee, it will be low enough
to retain as many subscribers as possible. I will make it the
lowest fee I can which is $10.00. I'll accept payment via
PayPal. Please note that this would be a one-time registration fee and not a recurring
subscription fee.
